Terms and conditions of sale
TEAM TARTUFI SRLS with registered office in Milan (Italy), C.so Venezia 8 20121 Milan, Tax Code / VAT number 10548790962 (hereinafter the "Company") is the owner of the site https://www.teamtartufi.com (hereinafter "TEAM ATRTUFI").
Acceptance of the general conditions of sale
1) The contract stipulated between TEAM TARTUFI and the user who purchased (hereinafter the "Customer") must be considered concluded with the acceptance, even if only partial, of the order by TEAM TARTUFI. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him with this document and / or during the purchase procedure, and to fully accept the general and payment conditions transcribed below.
2) If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity or does not make the purchase by indicating during the purchase and / or registration phase a reference of VAT number as defined in the article 3, paragraph 1, letter a) of the Consumer Code - hereinafter the "Consumer"), once the online purchase procedure has been completed, TEAM TARTUFI will send an e-mail copy of these Conditions of sale in .pdf format which the Customer will print or save and in any case keep, in compliance with the provisions of the current Consumer Code on distance selling. If the customer is not a Consumer, please see the following article 13.
3) The Customer acknowledges and expressly accepts that in order to purchase alcoholic beverages he must be at least eighteen years of age. The Customer therefore, in the act of completing an order that contains alcoholic beverages, expressly declares and guarantees to be of age. TEAM TARTUFI reserves the right in any case to ascertain the age of the Customer during the order processing phase as well as during the delivery phase. In case of ascertained lack of the aforementioned requirement, the order and / or delivery of alcoholic beverages will not be processed.
4) Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance by TEAM TARTUFI, even partial, of an order.
How to purchase
5) The Customer can only purchase the products and tickets for the events present in the electronic catalog at the time of placing the order and viewable online at (URL) https://www.teamtartufi.com as described in detail in the relevant sheets informative. It is understood that the image accompanying the description of a product may not be perfectly and completely representative of its characteristics but differ in color, size, accessory products shown in the figure. All purchase support information is intended as a simple generic information material, not referable to the real characteristics of a single product. The Customer may at any time request more information using the contacts referred to in the following art. 38.
6) TEAM TARTUFI reserves the right in any case to insert additional information and / or special conditions in the information sheets of the products and events. The Customer acknowledges and expressly accepts that any such information contained in the aforementioned information sheets will prevail over these conditions of sale.
7) Correct receipt of the order is confirmed by TEAM TARTUFI by means of an e-mail reply, sent to the e-mail address supplied by the Customer. This confirmation message will contain, in addition to the copy of these Conditions of Sale referred to in the previous art. 2, the summary of the order, to be used in any further communication with TEAM TARTUFI. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
8) In case of non-acceptance of the order, TEAM TARTUFI guarantees timely communication to the Customer.
Terms of payment
9) The Customer can pay the price of the products and the related delivery costs by credit card or Paypal or bank transfer.
10) Credit card (recognized and approved by TEAM TARTUFI)
In cases of purchase of goods with a credit card payment method, at the same time as the online transaction is concluded, the reference bank will authorize only the commitment of the amount relating to the purchase made. The amount relating to the goods processed, even partially, will be effectively charged to the Customer's credit card at the time of conclusion and acceptance by TEAM TARTUFI of the order.
10.1) In case of cancellation of the order in case of non-acceptance of the same by TEAM TARTUFI, TEAM TARTUFI will immediately request the cancellation of the transaction and the release of the committed amount. The release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiry date (24th day from the date of authorization). Once the transaction has been canceled, the Customer acknowledges and expressly accepts that in no case TEAM TARTUFI can be held responsible for any direct or indirect damage caused by delay in the failure to release the amount committed by the banking system.
10.2) TEAM TARTUFI reserves the right to request additional information from the Customer (eg landline telephone number) or to send copies of documents proving ownership of the Card used. In the absence of the required documentation, TEAM TARTUFI reserves the right not to accept the order.
10.3) At no time during the purchase procedure is TEAM TARTUFI able to know the information relating to the buyer's credit card, transmitted via a secure connection directly to the website of the bank that manages the transaction. No TEAM TARTUFI computer archive will keep such data. In no case TEAM TARTUFI can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment of the purchased products.
11) Purchases via Paypal
In cases of purchase of goods with PayPal payment methods, at the same time as the online transaction is concluded, PayPal will immediately charge the amount relating to the purchase made.
11.1) In case of cancellation of the order, both by the Customer and in case of non-acceptance of the same by TEAM TARTUFI, together with the cancellation, the amount relating to the canceled goods will be re-credited to the Customer's Paypal account. The re-credit times on the payment instrument chosen within the Paypal account depend exclusively on PayPal and the banking system. Once the amount has been credited back to the Paypal account, in no case TEAM TARTUFI can be held responsible for any direct or indirect damage caused by delays in the actual re-credit depending on Paypal or the banking system.
11.2) TEAM TARTUFI reserves the right to request additional information from the Customer (eg landline telephone number) to determine the actual ownership of the PayPal account. In the absence of the required documentation, TEAM TARTUFI reserves the right not to accept the order.
11.3) At no time during the purchase procedure TEAM TARTUFI is able to know the information relating to the buyer's credit card or other methods chosen within PayPal. In no case TEAM TARTUFI can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment of the purchased products.
Purchase as a professional or company
12) If the purchase is made by a professional, it will be possible to request an invoice by selecting the appropriate box during the order procedure and entering the billing data including tax code and / or VAT number. In this case the invoice will be sent via email to the address indicated. The professional is responsible for the correct insertion of billing data and is expressly informed that, in case of failure to request the invoice during the order, it will not be possible to request it later. If you opt for this method, it is necessary to remember that the professional is no longer considered a Consumer, and therefore will not be able to benefit from the rights reserved for consumers by the applicable legislation. The Customer acknowledges and expressly accepts that outside the Italian territory, TEAM TARTUFI will not accept orders from subjects other than natural persons.
Delivery methods and costs
13) For each order placed online, TEAM TARTUFI will issue a receipt for the material sent, which the user can find once he receives the products, in accordance with current provisions. For the issue of the receipt, the information provided by the Customer at the time of the order is valid. No change in the receipt will be possible after its issue.
14) Product prices are inclusive of all taxes and duties. All prices are expressed in Euros. The payment of the goods by the Customer will take place using the method chosen at the time of the order. Nothing is more due by the Customer than the total order.
15) No responsibility can be attributed to TEAM TARTUFI in case of delay in the order or delivery of the order.
16) Upon delivery of the goods by TEAM TARTUFI, the Customer is required to check that the number and nature of the products delivered; any discrepancies from the order placed must be notified within 7 days.
17) In the event of impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be returned to the TEAM TARTUFI sales points.
18) The costs are entirely borne by the Customer and will be indicated at the time of insertion by the latter, of all the requested data, including those relating to the destination of the products. Therefore, the Customer acknowledges and expressly accepts that the final cost of the shipment will be highlighted only once the mandatory fields have been completed. Any cost indicated by TEAM TARTUFI previously must be considered indicative and subject to change.
19) TEAM TARTUFI guarantees the direct delivery of all products only in the territory of the Municipality of Milan. For all other products we guarantee shipping by courier on the national and European territory. For shipments outside the EU, the methods will be defined on a case by case basis.
20) TEAM TARTUFI provides two standard shipping methods unless specific agreements with the customer.
Shipping times can vary from 24 to 72 hours on the national and European territory, while for non-EU shipments the times may vary from 3 to 15 days.
Right of withdrawal
The following does not apply with reference to food products in relation to which reference is made to the following point 25.
21) Pursuant to the Consumer Code, if the customer is a Consumer, he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following points 23, 24, 25 and 26.
22) The Customer has the right to withdraw from the contract within 14 days.
The period for exercising the right of withdrawal expires after 14 days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the goods.
To exercise the right of withdrawal, the Customer is required to inform TEAM TARTUFI using the contacts referred to in the following art. 37, of its decision to withdraw from this contract through an explicit declaration (for example a letter sent by post, fax or e-mail). To meet the withdrawal deadline, the Customer must send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
If the Customer withdraws from this contract, TEAM TARTUFI will reimburse the Customer for all payments made to TEAM TARTUFI, including delivery costs (with the exception of additional costs deriving from the Customer's possible choice of the shipping method. express as provided in the previous point 21), without undue delay and in any case no later than 14 days from the day on which TEAM TARTUFI was informed of the Customer's decision to withdraw from this contract. These refunds will be made using the same payment method used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise; in any case, TEAM TARTUFI guarantees that the Customer will not have to incur any costs as a consequence of this reimbursement.
The Customer acknowledges and expressly accepts that TEAM TARTUFI will have the right to suspend the aforementioned refund until the goods are received or until the Customer demonstrates that he has returned the goods, whichever is earlier.
The Customer must return the goods or deliver them to TEAM TARTUFI without undue delay and in any case within 14 days from the day on which he communicated to TEAM TARTUFI the intention to withdraw from this contract.
The goods must be returned intact, complete with all its parts and with the original packaging (envelopes and packaging), kept and possibly used according to normal diligence, without any signs of wear or dirt, in compliance with the conditions of the following points 24, 25. As foreseen by art. 57, paragraph 2 of the Consumer Code, the Customer will be responsible for the decrease in the value of the goods resulting from their handling other than that necessary to establish the nature, characteristics and functioning of the goods.
23) The right of withdrawal is however subject to the following conditions:
a) the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product;
b) by law, the shipping costs for returning the goods are charged to the customer;
c) the shipment, up to the certificate of receipt in the TEAM TARTUFI warehouse, is under the complete responsibility of the Customer;
d) in case of damage to the goods during transport, TEAM TARTUFI will notify the customer of the incident (within 5 working days from receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal;
e) TEAM TARTUFI is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
24) Without prejudice to the provisions of this contract and art. 57, paragraph 2 of the Consumer Code, TEAM TARTUFI will refund the customer the full amount already paid by transferring the amount charged to the credit card or by bank transfer. In the latter case, it will be the Customer's responsibility to promptly provide the bank details with IBAN code on which to obtain the reimbursement (Current Account of the invoice holder).
25) Exceptions to the right of withdrawal pursuant to art. 59 of the Consumer Code
The right of withdrawal pursuant to articles 52 to 58 of the Consumer Code for distance contracts and contracts negotiated away from business premises is excluded in relation to:
- order of products made to measure or clearly personalized;
- order of products that are likely to deteriorate or expire rapidly;
- order of sealed products which cannot be returned for hygienic reasons or related to health protection or which have been opened after delivery;
- order of services relating to leisure activities if the contract provides for a specific date or period of execution.
With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that the products that "risk deteriorating or expire rapidly" include all food products (including alcoholic beverages, wines and beverages in general) and that events are included among the “services relating to free time activities”.
Guarantees
The following applies with reference to the sale of all products with the exception of events and some products in relation to which the terms of guarantees may vary due to their perishable nature or as they are subject to expiration in a shorter term than that provided below in general.
26) All products sold by TEAM TARTUFI are covered by the manufacturer's conventional warranty and by the 24-month warranty for lack of conformity, pursuant to the Consumer Code. To use the warranty, the Customer must keep the invoice or receipt that he will receive via e-mail in PDF format. The exercise of the Warranty may provide for the request for assistance to the Authorized Service Centers present in the area and / or follow the procedures illustrated in the documentation inside the product packaging.
27) The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect is not covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as transport costs, if supported by TEAM TARTUFI.
28) The 24-month warranty pursuant to the Consumer Code applies to products that present a lack of conformity, provided that the product is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number). In case of lack of conformity, TEAM TARTUFI provides, at no cost to the customer, to restore the conformity of the product by repairing / replacing or reducing the price, until the contract is terminated. If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to the Consumer Code, the Customer will be charged for any verification and restoration costs required by the Authorized Service, as well as the costs of transport if supported by TEAM TARTUFI.
29) The Customer loses these rights if he does not report the lack of conformity to TEAM TARTUFI within two months from the date on which he discovered the defect, provided that it is not a product that by its nature is perishable or subject to expiry in a shorter period, in which case the defect must be reported within this shortened period.
30) The replacements in the event of a product not working on delivery take place only if expressly provided for by the manufacturer. The timing of replacement or repair of the product depends exclusively on the policies of the manufacturer.
31) In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its customer, TEAM TARTUFI may proceed at its discretion to refund the amount paid taking into account the use of the asset or its replacement with a product of equal or superior characteristics.
32) The repair or replacement times of the product depend exclusively on the manufacturer's policies and no damage can be requested from TEAM TARTUFI for any delays in carrying out repairs or replacements.
33) In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ..); to limit damage to the original packaging, it is recommended to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original product packaging should be avoided. The Customer will be provided with an authorization number for the return of the product (ARP) which must be indicated on the outside of the packaging, following the instructions provided directly in the relative authorization e-mail.
Intellectual and industrial property rights
34) TEAM TARTUFI informs that the Site, as well as all trademarks and distinctive signs used by TEAM TARTUFI in relation to the sale of products, is protected by the applicable intellectual and industrial property rights and that any type of reproduction, communication, distribution is prohibited , publication, alteration or transformation, in any form and for any purpose, of the site contents, trademarks and distinctive signs used by TEAM TARTUFI (such as, by way of example, the works, images, photographs, drawings, dialogues, presentations, music, sounds, videos, graphics, colors, features and design of the site).
35) TEAM TARTUFI assumes no responsibility for the trademarks and other distinctive signs that appear on the products it sells on the Site, with respect to which the Customer does not acquire any rights following the conclusion of the contract.

Information and Complaints
37) Any complaint must be addressed to TEAM TARTUFI by registered letter with return receipt and by e-mail to the addresses indicated in the Contact section.
Applicable law
38) The sales contract between the customer and TEAM TARTUFI is concluded in Italy and governed by Italian law. For the solution of any dispute deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Milan, with the exclusion of competing or alternative courts.
